1. Scope and provider
These General Terms and Conditions ("Terms") govern the use of the CableTime platform (the website cabletime.ch and the CableTime app) by customers ("Customers") and by trade and service businesses ("Companies"). The provider is Babala Özdemir (sole proprietorship), Unterer Rainweg 22, 4414 Füllinsdorf, UID CHE-322.105.560 ("CableTime", "we").
2. CableTime's services
CableTime is a matching platform. Customers describe assignments; suitable registered Companies from the region may submit quotes. CableTime is not a party to the contracts concluded between Customers and Companies, does not provide any trade or service work itself, and does not owe any successful match. There is no entitlement to a request receiving quotes or to a Company receiving a particular number of requests.
3. Account and registration
Customers may submit requests with or without an account. An account can be created with Apple, Google or an e-mail code. Companies must register and provide truthful, complete information (in particular company name, address or postal code, phone number, e-mail and, where available, UID). Access credentials must be kept confidential. Users must be of legal age and have full legal capacity. Accounts are not transferable.
4. Requests
Submitting a request is free of charge and non-binding for Customers. Customers describe the assignment truthfully and upload only photos to which they hold the rights and in which no third parties are identifiable. By submitting a request, Customers consent to the description of their assignment being forwarded without contact details to suitable Companies in their region. Customers may close a request at any time.
5. Quotes and conclusion of contract
Quotes from Companies are offers made by the respective Company; price information (fixed price, "from" price or hourly rate) is the Company's sole responsibility. By clicking "Accept quote", the Customer declares to the Company that they wish to award the assignment on the basis of the quote; details (scope, final price, date, payment) are agreed directly between Customer and Company. The contract for the work is concluded exclusively between Customer and Company. Execution, warranty, payment and any disputes are the sole responsibility of these two parties. CableTime does not collect any payments for jobs and does not process payments between Customers and Companies. The only payment made to CableTime is the Company subscription (section 8).
6. Contact details, messages and appointments
The Customer's contact details are only forwarded to a Company once the Customer accepts its quote or expressly releases the contact. Customers then receive the Company's contact details. Contact details and messages may be used exclusively to process the relevant request; any disclosure or use for advertising is prohibited. Appointments arranged via the platform serve as reminders and are not binding on CableTime.
7. Reviews
Customers may review a Company whose quote they have accepted (one review per assignment). Reviews must be based on the reviewer's own experience and must be factual and truthful. Reviews are displayed on the public Company profile together with first name and location. CableTime may remove reviews that violate these Terms or applicable law. Buying, coercing or falsifying reviews is prohibited.
8. Company subscription
Companies can see the details of suitable requests and submit quotes while their subscription is active. Price and conditions are displayed on cabletime.ch before conclusion. The subscription runs for one month at a time and automatically renews for a further month unless cancelled before expiry; cancellation is possible at any time with effect at the end of the current period. Payment is made in advance via our payment provider Stripe. Periods already paid for are not refunded on a pro-rata basis, unless CableTime is responsible for a failure. The subscription is concluded and managed exclusively on the website. CableTime may adjust prices for the following period with at least 30 days' notice; in that case the Company may cancel with effect from the date of the change.
9. Notifications
CableTime informs about new requests, quotes, messages, appointments and reminders by e-mail, push notification and – for Companies that have activated it – by SMS. Notifications can be unsubscribed from at any time in the settings or via the unsubscribe link.
10. Obligations and prohibited use
The following are in particular prohibited: false or misleading information, sham requests and sham quotes, circumventing the contact release, spam and advertising, offensive, discriminatory or unlawful content or content infringing the rights of third parties, automated extraction of data from the platform, and any act that impairs security or operation. Inappropriate content can be reported in the app via "Report" or to info@cabletime.ch. CableTime may remove content and temporarily or permanently suspend accounts in the event of violations; for Companies with an active subscription, any entitlement to a refund lapses in the event of serious violations.
11. Content and usage rights
Users remain the owners of the rights to their content (texts, photos, company descriptions, reviews). They grant CableTime the free, non-exclusive right to store and display this content for the operation of the platform and to make it accessible to the respective authorised users. The platform, its design, texts and software are protected by copyright.
12. Availability
CableTime endeavours to ensure trouble-free operation but does not guarantee uninterrupted availability. Maintenance work, technical disruptions and further development are reserved.
13. Liability and disputes
CableTime is not liable for the accuracy of information provided by users, for the quality, execution, timeliness or prices of work performed by Companies, for payments between Customers and Companies, or for the conclusion of contracts. To the extent permitted by law, any liability of CableTime for slight negligence, indirect damages and loss of profit is excluded. Liability for intent and gross negligence, as well as mandatory statutory liability, remains reserved.
CableTime is under no circumstances a party to the relationship between Customer and Company. All legal questions and claims arising from a job – in particular conclusion of the contract, price, payment, defects and warranty, delay, property damage and personal injury, insurance, withdrawal and disputes of any kind – exist exclusively between Customer and Company and must be resolved directly between them.
Companies are solely responsible for professional execution, required permits and professional qualifications, insurance (in particular business liability insurance), taxes, social security contributions and compliance with employment law and all other legal requirements. CableTime does not verify Companies, their qualifications or their information and gives no warranty in this respect.
To the extent permitted by law, Customers and Companies shall indemnify and hold CableTime harmless from all third-party claims arising from their content, their conduct or jobs between Customer and Company. CableTime does not mediate disputes and is not obliged to take part in them; disclosure of data on the order of an authority or court remains reserved.
14. Data protection
The processing of personal data is governed by our privacy policy.
15. Changes to these Terms
CableTime may amend these Terms. Changes are published on the website; registered Companies are informed in advance by e-mail of material changes. Continued use after the changes take effect constitutes acceptance of the amended Terms.
16. Account deletion and termination
Customers and Companies may delete their account at any time in the app or on the website. A current Company subscription ends upon expiry of the paid period.
17. Applicable law and jurisdiction
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention). The place of jurisdiction is Liestal (canton of Basel-Landschaft). Mandatory places of jurisdiction, in particular for consumers, remain reserved.
